BIS Updates on Gypsum Plaster Boards and Glass Fibre Boards

On 6th March 2024, the Ministry for Promotion of Industry and Internal Trade (PIIT) has released a pivotal Quality Control Order (QCO) concerning Gypsum Plaster Boards and Glass Fibre Boards. This update covers standards IS 2095 (Part 1):2011, IS 2095 (Part 2):2022, IS 2095 (Part 3):2022, and IS 17400:2021, and it marks a significant milestone for all stakeholders involved in the production, distribution, and import of these crucial construction components. For foreign companies looking to export these products to India, understanding and adhering to these updated standards is crucial for ensuring smooth market access and avoiding potential pitfalls. These standards are mandatorily applicable with effect from the expiry of 6 months from the date of publication i.e from 5th of September 2024.

The Importance of BIS Compliance

The updated BIS standards emphasize adherence to Indian Standards (IS), underscoring the importance of maintaining high safety and quality benchmarks. Compliance with these standards is not just a regulatory requirement but a critical factor in ensuring that products meet the expectations of the Indian market. Foreign companies must recognize that importing products requiring mandatory BIS certification without obtaining the products would not be allowed to have custom clearance. This could ultimately harm their business prospects in India.

Quick Compliance Check for New Entrants

For companies entering the Indian market, a quick compliance check can be facilitated by collaborating with their quality team who are well-versed in accessing the necessary certifications. The quality team can help navigate the certification process, ensuring that the products meet the required BIS standards before they enter the Indian market.

Implications for Foreign Companies Importing into India

1. Penalties and Detention: Customs authorities in India have the authority to detain and seize goods imported without the necessary BIS certificate. This can lead to substantial penalties and delays in customs clearance, causing financial losses and disruptions in supply chains.

2. Legal Consequences: Importing non-compliant products can lead to severe legal consequences, including fines, legal actions, and potential blacklisting by Indian authorities, severely impacting the company’s ability to operate in the market.

3. Non-Compliance with Industry Standards: BIS registration ensures that imported goods adhere to the prescribed industry standards, contributing to consumer safety and promoting fair competition in the Indian market.

4. Loss of Market Opportunities: Without BIS certification, importers may miss out on lucrative market opportunities in India. Many government tenders and institutional contracts require products to be BIS-compliant, limiting access to potential business deals.

5. Permission to enter the product into Indian Market: In case of mandatory BIS registration, product will not be allowed to clear the Indian Custom unless the product is registered with BIS. Thus the sale and supply of product into Indian market will be completely jeopardised in absence of registration of product with BIS.

BIS UPDATES
BIS certification scheme is basically voluntary in nature. However, for a number of products compliance to Indian Standards is made compulsory by the Central Government under various considerations viz. public interest, protection of human, animal or plant health, safety of environment, prevention of unfair trade practices and national security.
